Estimates
Project estimates are valid for 60 days from the date of estimate. The project may be reestimated if, upon receipt of all project elements, Deciacco Design determines the scope of the project has been altered dramatically from the originally agreed upon concept. Printing fees will be estimated separately and payment arrangements made between The Client and printer.
Revisions and alterations
New work requested by The Client and performed by Deciacco Design after a proposal has been approved is considered a revision or alteration and will be billed at an hourly rate. If the job changes to an extent that substantially alters the specifications described in the original estimate, a revised additional fee must be agreed to by both parties before further work proceeds.
Meetings and presentations
Additional meetings and presentations will be charged at an hourly rate.
Errors and omissions
It is The Clients responsibility to check electronic proofs provided by Deciacco Design carefully for accuracy in all respects. The Clients e-mailed approval is required for all artwork prior to supplying to chosen print house or other implementation. It is The Clients responsibilty to approve a printed/digital proof from your chosen print house prior to printing. Deciacco Design will not be liable for reprinting costs in the event of errors, omissions or colour variations.
Payment schedule
A deposit in an amount equal to 30% of the total estimated cost is requested prior to execution of the project. The remaining balance is due within 30 days from receipt of final invoice. In accordance with The Late Payment of Commercial Debts Act 1998 interest will be charged on all payments received outside of payment terms at the rate of 5% above the Bank of England base rate. If your cheque is returned by the bank as unpaid for any reason, you will be liable for a returned cheque charge of £25. Payment is accepted by cheque made payable to Claire Deciacco or bank transfer, details supplied on request.
Reproduction of work
One time reproduction rights are granted to The Client upon payment for completed project, any other usage must be negotiated. Design, graphics and programming produced by Deciacco Design remain the intellectual property of Deciacco Design. Deciacco Design retains personal rights to use the completed project and any preliminary designs for the purpose of marketing our business. Where applicable The Client will be given any necessary credit for usage of the project elements.
Copyrights and trademarks
The Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork provided to Deciacco Design for inclusion in the project are owned by The Client, or that The Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend Deciacco Design from any liability arising from the use of such elements.
Design credit
A credit or link reading ‘design by www.deciacco.co.uk’ will appear in small type at the bottom of The Clients design where appropriate.
Supplier's performance
We will use our best efforts to ensure quality and timely delivery of all printed pieces should you request that we coordinate your print. This service incurs an additional print handling fee detailed in your estimate if applicable. Although we use our best efforts to guard against any loss to you through the failure of our vendors to perform in accordance with their commitments, Deciacco Design is not responsible for failure on their part.
Rejection or cancellation of project
The Client shall not unreasonably withhold acceptance of, or payment for, the project. If, prior to completion of the project, the client observes any nonconformance with the design plan, Deciacco Design must be promptly notified, allowing for necessary corrections. Rejection of the completed project or cancellation during its execution will result in forfeiture of deposit and the possible billing for all additional labor and expenses to date. All elements of the project must then be returned to Deciacco Design. Any usage by the client of those design elements will result in appropriate legal action.
Completion and delivery of project
Any delivery costs will be assumed by The Client. Any alteration or deviation from the above specifications involving extra costs will be executed only upon approval with The Client. Any delay in the completion of the project due to actions or negligence of The Client, unusual transportation delays, unforeseen illness, or external forces beyond the control of Deciacco Design, shall entitle Deciacco Design to extend the completion/delivery date, upon notifying The Client, by the time equivalent to the period of such delay.
